Terms & Conditions

These Terms and Conditions (‘Terms’) govern your use of https://massageeden.co.nz (the ‘Website’) and the massage therapy services (‘Services’) provided by Massage Eden Ltd (‘we’, ‘us’, ‘our’) at our three locations in New Zealand. By using our Website, booking an appointment, or attending a treatment, you agree to be bound by these Terms. If you do not agree, please do not use our Website or Services.

1. About us

These Terms apply to all three locations.

2. Definitions

‘Client’, ‘you’, and ‘your’
mean any person who books or attends a treatment, or who uses the Website.
‘Massage Eden’, ‘we’, ‘us’, and ‘our’
mean Massage Eden Ltd, including all three of our locations.
‘Treatment’
means any massage therapy service we provide at any of our locations.
‘Therapist’
means any massage practitioner working at any of our premises.
‘Premises’
means any of our three locations listed in section 1.

3. Bookings

Appointments can be booked through our Website (powered by Timely), by phone, by email, or in person at any of our locations.

When you book, you select the location, treatment, and time. A booking is confirmed once you receive a confirmation email or message from us.

You are responsible for providing accurate contact details and selecting the correct location when making a booking.

No deposit or pre-payment is required to confirm a booking. Payment is taken at the time of treatment, unless you have paid in advance (for example, by redeeming a gift voucher).

We may require valid card details to be held on file at the time of booking to secure your appointment, in line with our cancellation policy in section 4.

4. Cancellations and no-shows

We require notice if you need to cancel or reschedule an appointment. The fee depends on how much notice you give:

12 to 24 hours 50% of the treatment cost
Less than 12 hours 100% of the treatment cost
No-show (no notice at all) 100% of the treatment cost

Charges may be processed using the card held on file via Stripe or Timely Pay.

We may waive cancellation fees in genuine emergencies, at our discretion.

5. Late arrivals

If you arrive late, your treatment time may be reduced so that following appointments are not affected, if necessary.

You will still be charged the full treatment fee unless we agree otherwise.

6. Pricing and payment

  • Treatment fees are payable at the time of the appointment, unless paid in advance.
  • We accept payment by EFTPOS, credit and debit cards (via Stripe and Timely Pay), and other methods displayed at our premises.
  • Prices displayed on our Website and at our premises are in New Zealand dollars and include GST where applicable.
  • Pricing is consistent across all three of our locations unless otherwise stated.
  • We may change our prices from time to time. The price applicable to your booking is the price displayed at the time the booking is confirmed.

7. Gift vouchers

  • Gift vouchers can be purchased through our Website or in person at any of our locations.
  • Vouchers are valid for 36 months from the date of purchase, unless otherwise stated on the voucher.
  • Vouchers can be redeemed at any of our three locations.
  • Vouchers are issued either for a specific treatment (e.g. ‘60-minute massage’) or for a monetary value (e.g. ‘$120 of services’), as stated on the voucher.
  • Where treatment prices have increased between the date of purchase and the date of redemption, the voucher holder is responsible for paying the difference at the time of redemption.
  • Vouchers cannot be redeemed for cash and cannot be exchanged for other products or services.
  • Vouchers must be presented at the time of the appointment.
  • Lost or stolen vouchers cannot be replaced.

8. Health and intake

  • Before your first treatment, you must complete a health intake form.
  • You must disclose any medical conditions, injuries, medications, allergies, pregnancy, or other health information that could affect your treatment.
  • You must inform your therapist of any changes to your health between visits.
  • Failure to disclose relevant health information may put you at risk and may result in us declining or terminating treatment.
  • Massage therapy is not a substitute for medical advice or treatment. If you have a medical condition, you should consult a qualified medical practitioner.

9. Code of conduct

Our therapists provide professional, therapeutic massage in a safe environment at all of our premises. To maintain that environment:

All Treatments are strictly therapeutic in nature. We do not provide, and will not tolerate requests for, any form of sexual service.

Inappropriate, threatening, abusive, or sexual behaviour towards therapists or staff will result in immediate termination of the treatment, full charge of the fee, and a ban from future bookings at all of our locations. Conduct that may constitute a criminal offence will be reported to the New Zealand Police.

We reserve the right to refuse or terminate service, without refund, to any person who:

  • Is under the influence of alcohol or non-prescribed drugs
  • Has an untreated infectious or contagious skin condition
  • Has failed to disclose relevant health information
  • Behaves in a manner that makes our therapists or other clients feel unsafe

10. ACC claims

We do not currently accept ACC-funded treatment. If you have an ACC claim that covers massage therapy, you will need to arrange treatment with an ACC-registered provider.

11. Rotorua location (Pullman Hotel)

Our Rotorua location operates inside Pullman Hotel Rotorua. While the Massage Eden treatment space is operated by us and our staff, the wider hotel environment (including the lobby, hotel parking, and shared hotel areas) is operated by Pullman and is subject to Pullman’s own terms, rules, and policies.

Your booking with us does not include any goods or services provided by Pullman Hotel Rotorua.

Massage Eden is not responsible for any matter relating to your stay at Pullman or your use of Pullman’s facilities.

12. Website use and intellectual property

You may use our Website for personal, non-commercial purposes only.

All content on the Website (including text, images, branding, and the Massage Eden name and logo) is owned by us or our licensors and is protected by intellectual property law.

You must not:

  • Copy, reproduce, distribute, or republish content from the Website without our written permission
  • Use the Website in any way that is unlawful, fraudulent, or harmful
  • Interfere with the operation of the Website or attempt to gain unauthorised access

13. Linking and third-party content

You may link to our home page, provided the link is not deceptive, does not falsely imply endorsement or affiliation, and is not associated with content that is unlawful, offensive, or damaging to our reputation. We reserve the right to require removal of any link.

Our Website may contain links to third-party websites (including Pullman Hotel Rotorua’s website in relation to our Rotorua location). We do not control or endorse those sites and are not responsible for their content, accuracy, or privacy practices.

14. Limitation of liability

We provide our Services with reasonable care and skill, in accordance with professional massage therapy standards.

We do not guarantee any specific outcome or therapeutic result. Individual responses to massage therapy vary.

Information on our Website is for general information only and does not constitute medical advice.

To the maximum extent permitted by law, we are not liable for any indirect, consequential, or incidental loss arising from your use of the Website or our Services.

Nothing in these Terms limits or excludes:

  • Our liability for death or personal injury caused by our negligence
  • Our liability for fraud or fraudulent misrepresentation
  • Any rights you have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 that cannot be contracted out of

15. Consumer rights (New Zealand)

Where you receive our Services as a consumer, the Consumer Guarantees Act 1993 provides statutory guarantees that cannot be contracted out of. These include that our Services will be provided with reasonable care and skill, will be fit for any particular purpose made known to us, and will be provided within a reasonable time.

The Fair Trading Act 1986 prohibits us from engaging in misleading or deceptive conduct in trade.

These Terms do not affect any rights you have under those Acts.

16. Privacy

We handle your personal information in accordance with our Privacy Policy, the Privacy Act 2020, and the Health Information Privacy Code 2020.

17. Changes to these Terms

We may update these Terms from time to time. The ‘Last updated’ date at the top shows when they were last changed. Material changes will be notified on our Website. Your continued use of the Website or our Services after a change means you accept the updated Terms.

18. Governing law and disputes

These Terms are governed by the laws of New Zealand.

Any dispute arising from these Terms or our Services is subject to the exclusive jurisdiction of the courts of New Zealand.

Before pursuing formal action, we encourage you to contact us first to try to resolve the matter informally. For consumer disputes within the relevant monetary limit, the Disputes Tribunal of New Zealand may also be available.
